Terms of Use – What? Ask AI

Welcome to What? Ask AI! By downloading, installing, or using the What? Ask AI mobile application (the “App”), developed by Robert Gaffaney under Comquest Corporation, you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

1. Acceptance of Terms

These Terms form a binding agreement between you and Robert Gaffaney / Comquest Corporation. Use of the App constitutes acceptance. We may update these Terms at any time; continued use after changes means you accept the new version.

2. Subscription Tiers & In-App Purchases

The App is free to download and offers three subscription tiers: Free, Standard, and Premium. Paid tiers remove advertisements and unlock higher usage limits.

• Free Tier: Includes ads and basic usage limits.
• Standard Tier: Removes ads and provides increased chat and follow-up limits.
• Premium Tier: Removes ads, provides the highest limits (up to 10,000 chats total and 100 follow-ups per conversation), and unlocks full features.
• Subscriptions are processed exclusively through the Apple App Store or Google Play Store and are subject to their respective terms.
• Paid subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• All purchases are non-refundable except where required by law. For billing issues, contact Apple or Google support.
• Upon successful subscription or purchase, advertisements are removed and AdMob advertising-related data collection ceases.

3. User Conduct & Content

You are responsible for the prompts you enter and any outputs the App generates. You agree not to use the App to:

• Generate or distribute illegal, harmful, defamatory, or abusive content.
• Infringe intellectual property, privacy, or publicity rights of others.
• Attempt to reverse-engineer, decompile, hack, or interfere with the App.
• Use the App for commercial purposes without express written permission.

We reserve the right to moderate, block, or terminate access if we believe violates these Terms.

4. Intellectual Property

The App, its design, code, and branding are owned by or licensed to Robert Gaffaney / Comquest Corporation. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

5. Privacy

Your privacy is important to us. Please review our dedicated Privacy Policy at https://cqcorp.com/what-privacy-2025.html which explains how queries, advertising data, and any voluntary contact information are handled.

6. Third-Party AI Services

The App sends your queries to third-party artificial intelligence providers to generate responses. We do not control and are not responsible for the accuracy, appropriateness, or legality of those responses. Use the generated content at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Robert Gaffaney / Comquest Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. Total liability is limited to the amount you paid us in the preceding 12 months (or $50 if no payment was made).

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice.

9. Governing Law

These Terms are governed by the laws of the United States and any disputes shall be resolved in the courts located there.
